The eThekwini Municipality welcomes the judgment of the High Court of South Africa, KwaZulu?Natal Division, Durban, delivered on 30 September 2026.
The Court dismissed an application seeking to review and overturn the City’s planning decisions relating to the former Beachwood Golf Course site.
The Friends of Beachwood and a second applicant had challenged municipal decisions on subdivision, the removal of restrictive title conditions, servitudes, and rezoning. They also sought to have the classification of the Beachwood development as a catalytic project declared unlawful. The Court found that such classification falls squarely within the policy?making powers of local government and dismissed the challenge.
Importantly, the Court rejected all review grounds against the Municipality and confirmed that there was no evidence the project’s catalytic designation influenced the technical assessment of the development application.
The Beachwood development represents a R3.6 billion capital investment and is expected to generate approximately 2,500 jobs during its roll?out phases.
City Manager Musa Mbhele said:
“This ruling reinforces eThekwini Municipality’s unwavering commitment to building a resilient economy, attracting major capital investment, and driving sustainable job creation for our residents. By upholding our planning decisions, the Court confirms that the Municipality acted lawfully and within its powers when considering this development.”
Mbhele further emphasised:
“A catalytic designation is not a shortcut. Every project undergoes rigorous technical evaluation in terms of the Spatial Planning and Land Use Management Act and the City’s Planning By?law. The judgment affirms that the classification of a project as catalytic does not replace or bypass the statutory planning processes that must be followed.”
The Municipality respects the right of residents to approach the courts and will continue to engage communities as development proceeds.
